A wrongful death occurs when an individual is fatally injured due to the misconduct or negligence of another person, company, or entity. However, today all 50 states have enacted wrongful death statutes intended to address such tragedies. Wrongful death can occur as a result of many situations including drunk driving, the manufacture and distribution of a defective product or failure to diagnose a fatal disease.
